These Terms of Service ("Terms") govern your access to and use of the SixPoints platform, operated by SixPoints LLC, a Wyoming limited liability company ("SixPoints," "we," "us," or "our"). By creating an account or using the platform, you agree to these Terms in full.
SixPoints is a B2B SaaS product. It is intended for use by licensed ISO brokers and underwriting professionals only. If you are not acting in a professional capacity in the merchant cash advance or commercial lending industry, you are not authorized to use this platform.
SixPoints is a pre-submission underwriting intelligence tool. It is designed to help licensed ISO brokers analyze bank statements, grade paper quality, size offers, and identify relevant funders before submitting a deal.
SixPoints is not a lender. SixPoints is not a broker. SixPoints does not make funding decisions, approve or deny applications, or participate in any funding transaction. We have no funding relationships and no financial interest in the deals you work.
All analysis outputs generated by the SixPoints platform, including paper grades, offer size estimates, funder match rankings, and any other results, are informational only. They do not constitute financial advice, legal advice, credit decisions, or recommendations of any kind.
You are solely responsible for your own underwriting decisions, deal submissions, and compliance with applicable laws and regulations. SixPoints outputs are one input among many. You must apply your own professional judgment to every deal.
By uploading any merchant financial document to the SixPoints platform, you represent and warrant that you have obtained proper authorization and consent from the merchant to submit their financial information for analysis. You may not upload documents for which you do not have authorization. SixPoints LLC is not responsible for any unauthorized use of merchant data you submit.
You must be at least 18 years of age and authorized to act on behalf of a licensed business entity to use SixPoints. By creating an account, you represent that the information you provide is accurate and that you have the authority to bind your organization to these Terms.
Access to SixPoints is provided on a subscription basis. Subscription fees are billed in advance per the plan you select at signup. All fees are non-refundable once analysis has been run during a billing period. We reserve the right to modify pricing with reasonable notice to active subscribers.
If payment fails or your subscription lapses, we may suspend or terminate your access to the platform.
You may not use SixPoints to:
SixPoints LLC may suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in conduct that we determine to be harmful to the platform, other users, or third parties. You may cancel your subscription at any time through your account settings or by contacting us.
The SixPoints platform is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the platform will be error-free, uninterrupted, or that analysis outputs will be accurate or complete. Use of the platform is at your own risk.
To the fullest extent permitted by law, SixPoints LLC will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the platform or reliance on any analysis output. Our total liability to you in any circumstance will not exceed the amount you paid for the platform in the three months preceding the claim.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of law principles. Any disputes arising under these Terms will be resolved in the courts of Delaware.
We may update these Terms from time to time. Material changes will be communicated via email or a notice within the platform. Continued use of the platform after updated Terms are posted constitutes your acceptance of the changes.
